Elvis Dumervil To File Lawsuit Against Miami Police Department, According To Report

Denver Broncos defensive lineman Elvis Dumervil will file a lawsuit against the Miami police, per Adam Schefter of ESPN. According to Dumervil's attorney, Harvey Steinberg, the lawsuit will be filed against the police department and the city of Miami for false arrest and defamation.

Dumervil was arrested in July for felony aggravated assault with a deadly weapon after allegedly brandishing a weapon in his waistband during a traffic altercation. Dumervil was accused of showing a gun to another driver after apparently being cut off during slow traffic.

The Broncos lineman had said at the the time that the "truth will come out" and that he was innocent of the charges, with those close to Dumervil stating that he was not carrying a gun and that neither the Land Rover nor a confiscated gun belonged to him.

Charges were formally dropped against Dumervil on Aug. 7.

Elvis Dumervil's Arrest Won't Result In Charges, According To Report

Elvis Dumervil will not be charged following his July arrest for felony aggravated assault with a deadly weapon. The Denver Broncos defensive end was arrested for allegedly revealing a gun tucked in his waistband during a verbal altercation with a motorist.

Dumervil has maintained his innocence in the incident, telling the Denver Post that "the truth will come out." Sources close to Dumervil said that he wasn't carrying a gun, nor did he own the gun confiscated within the Land Rover he was driving.

Police were called when Dumervil allegedly confronted another driver who had tried to merge in front the Land Rover in the midst of standstill traffic. There is no word yet whether the NFL will take disciplinary action.

Elvis Dumervil Says 'Truth Will Come Out' About Arrest

On Saturday night, Denver Broncos defensive end Elvis Dumervil was arrested and charged with aggravated assault with a deadly weapon. Dumervil reportedly got into a verbal altercation with a motorist and allegedly revealed a gun.

Mike Klis of the Denver Post reports that the police are still investigating, including taking fingerprints from two pistols that they confiscated from the Land Rover that Dumervil was driving on Saturday.

"The truth will come out," Dumervil told the Denver Post via text message.

According to two sources close to Dumervil, he was not carrying a gun and neither the Land Rover or the confiscated gun belonged to him.

The 911 call that brought police to the scene of the accident does not appear to implicate Dumervil. If Dumervil is eventually found to have been involved in the incident, he could be subject to NFL conduct policies.

Elvis Dumervil Allegedly Showed Gun Before Arrest

Elvis Dumervil's weekend arrest for felony aggravated assault with a deadly weapon was the result of a traffic dispute in which the Broncos defensive end allegedly brandished a gun, according to NFL.com's Gregg Rosenthal.

On Saturday night in Miami Beach, Dumervil got into a verbal altercation with the driver of another car after that car attempted to merge in front of Dumervil's while traffic was at a standstill. According to witness accounts, Dumervil then approached the other car and allegedly showed a firearm stored in his waistband.

Dumervil backed off and returned to his car, allowing the other car to attempt to retreat from the scene and was, along with a passenger, led out of his car at gunpoint by police.

This isn't Dumervil's first brush with the law — assault and disturbing the peace charges were filed against him in 2010, but later dropped — and that could lead to the NFL viewing him as a repeat offender when deciding on whether to mete out punishment.
