Okay. I couldn't care less if Lawless is the manager then.

He is such a clown.
Commented on Houston Astros relieve Bo Porter of his managerial duties on Sep 1 2014, 7:09p
Kind of a weird thing to be embarrassed about. Managers get canned all the time.

As someone who follows the Cards closely, the notion that Luhnow didn't play nice with LaRussa/Duncan, versus the other way around, is an interesting way of looking at it.....

Pretty sure that if asking for another team's best prospect in a mid-season trade is considered embarassing, then there are going to be lot of embarassed GMs out there.

Almost...

Luhnow looks a little like Dave Foley (from NewsRadio), imo.

I'm saying that I think the rough edges are a function of others' reactions/perceptions based on Luhnow's background, so they're always going to be there, regardless of what Luhnow does (except quit or stop exerting his authority).
Commented on Reports: Tension brewing between Porter, Luhnow and Astros front office on Aug 29 2014, 2:43p - 3 replies
Nothing is going to completely fix the issue that Luhnow is not a baseball lifer; he is not one of "them." (And this goes as well for others in his circle)

Meh. Looks like run-of-the-mill pot-stirring over issues that get smoothed over.

Conditions are disfavored in contract law, and are very, very rarely implied.
Commented on Brady Aiken, Jacob Nix and the Astros: Another brief Q&A for a weird situation on Aug 28 2014, 3:11p
Important terms (like whether there is a specific condition) can be left out of oral or written contracts.

Just speculating that there may have been one since they are commonly used in situations like this.

Sorry, not following the point here.

The allegation is that there was an oral contract; as well, there may have been a term sheet.

I'm not following, tbh.

I wouldn't agree that anything I said has anything to do with Close's character.

I don't see how the arbitrator is going to take a chunk out of the CBA.

There are two different issues.
Commented on Brady Aiken, Jacob Nix and the Astros: Another brief Q&A for a weird situation on Aug 28 2014, 12:14p
If Nix and the Stros want to settle the greivance, why would the MLBPA stand in their way?

Lambson is interesting and likely on the fence (and going to the AFL, I believe)

Since the change in Rule 5 eligibility (basically, from 2007 to the present)...

I don't think the Phils have any intention of trading Hamels.
Commented on Astros Prospect Report: Corpus Christi nukes San Antonio on Aug 26 2014, 6:00p
Too light, IMO. Doubt the Phils are going to give up Hamels without a headline prospect (top 25 in baseball)

I don't know. In his limited time at CC, his whiff% is about 15% higher than Texas League average and his contact% is right at league average.
Commented on Astros Prospect Report: Mark Appel Has One Rough Inning on Aug 22 2014, 3:16p
Yes, whether a pitch in the middle of the strike zone ends up resulting in a hit or an out also has a large "luck" component to it.
Commented on Astros Prospect Report: Mark Appel Has One Rough Inning on Aug 22 2014, 3:00p - 1 reply
Yes, I explicitly considered this above
Commented on Astros Prospect Report: Mark Appel Has One Rough Inning on Aug 22 2014, 2:47p - 1 reply
He's pitched like 64 innings this year total so we couldn't necessarily conclude anything about luck, inlcuding whether he's been unlucky, by looking at his statline.
Commented on Astros Prospect Report: Mark Appel Has One Rough Inning on Aug 22 2014, 2:04p - 2 replies
I think the main point is that it just doesn't matter performance-wise, and so the factors you note come to the fore.
Commented on Astros Prospect Report: Mark Appel Has One Rough Inning on Aug 22 2014, 1:22p - 1 reply
I think it's the first or second-most likely scenario (along with Nix's grievance simply being denied, and the status quo persisting)

I would be very, very surprised if any lawsuit came out of this.

Yeah, it depends how these first-year player contracts are set up, and I don't know.
Commented on Wednesday's Three Astros Things on Aug 20 2014, 6:19p
A third party (not a party to the contract) can tortiously interfere with a contract by wrongfully inducing one of the parties to breach it.

They are independent and jointly chosen by MLB and the MLBPA.

Yes, one of my law partners was a lawyer for Pennzoil on that case.

The issue is that signing Aiken was not truly a condition precedent to signing Nix.

Something is "proved" when one party has met its burden of proof on a disputed fact.

Verbal agreements are enforceable, and get proved and enforced all the time in courts and arbitrations.
