Today's news includes a few stories about an upcoming Esquire article that will imply that Joe Paterno knew more about the 1998 shower incident than he let on because - get this - he cancelled a 4 day vacation trip to NJ.
Meanwhile there is a new extensive interview with Sandusky Lawyer "Lawyerin Joe Amendola" that offers some insight into JS and the "I wish I were dead" statement in 1998
And it should come as a surprise to no one here that The Second Mile is refusing to turn over information
Each of these items are indicative of renewed interest from the media as the trial approaches. .
McQueary Story Changes Again
This could really change everything for PSU in the Sandusky case. and this should truly concern all PSU alumni, students, and supporters.
Court paperwork filed Monday, by prosecutors says the alleged sexual incident McQueary claims to have seen between Sandusky and a young boy in a locker room shower didn’t actually happen the Friday before spring break in 2002. It happened Feb. 9, 2001, about 13 months earlier. This puts at least part of the case beyond the statute of limitations.

A Very Sweet Sixteen - UPDATE comparison
Since no one else has provided a BSD review of the Lady Lions magnificent victory over Nikki Caldwell's LSU Lady Tigers down in Baton Rouge last night I feel compelled to give it a shot. As a rather rabid Women's College Basketball fan from the mecca of the sport down here in Knoxville Tennessee - home to the Women's Basketball Hall of Fame, Pat Summit the coach with the most wins in NCAA basketball history, and the Lady Vols, I do have a perspective to offer.
It also happens that my exwife taught art to Nikki Caldwell at Oak Ridge High School nearby and we watched her development as a high school player 22 years back and wrote to Coach Summitt early in her HS career to urge her to pay attention to her future star player and assistant coach.
And I agree with others who hope Nikki will return home to take over for Pat as Lady Vol head coach when she decides to step down. - but this is about the Penn State Lady Lions and what they accomplished in Baton Rouge last night.

PSU Lady Lions Vs LSU Lady Tigers - SWEET SIXTEEN!!!
The game is on ESPN2 or ESPN3 for those of you who want to see a great battle for a spot in the Sweet Sixteen.
Perhaps this can serve as a game thread tonight for those who want to stay up late and enjoy the game together.
So you don't have to visit the hated ESPN website here's the preview for the game between two of my favorite coaches and teams.
The parallel lives of Penn State coach Coquese Washington and LSU coach Nikki Caldwell are about to cross paths again, with a guarantee that one of them will reach uncharted territory in their up-and-coming coaching careers.
Washington, in her fifth season as a head coach, and Caldwell, in her fourth, are no strangers to the second round of the NCAA tournament, in which they'll meet Tuesday night when the fourth-seeded Lady Lions (25-6) play the No. 5 seed Lady Tigers (23-10).
Neither has coached a third-round game yet, though it would seem that both will have plenty more chances to take their teams on deep runs in March.
"It's like our generation that's coming into play as far as coaches, and it's exciting to be able to go against people that you played against," said Caldwell, a former player at Tennessee.
Penn State advanced to the second round of last year's tournament, while Caldwell coached UCLA to the second round the past two seasons before being hired away by LSU.
It's clear that Caldwell, 39, and Washington, 41, have gained rapid respect from some of more tenured coaches in women's basketball. San Diego State coach Beth Burns called them "the future of our game," before her Aztecs fell to LSU in the tournament's opening round.
Caldwell and Washington met three times as players from 1991-93, with the Lady Vols beating Washington's Notre Dame squad each time.
The future of Women's Basketball as far as great coaches go will be on display tonight. I hope you join me for the game.

Almost halftime at LSU where the Lady Lions are in a dead heat with UTEP in a 4 seed vs 13 seed match up for the right to meet the winner of LSU vs San Diego State on the home court for Nikki Caldwell's Lady Tigers. This has been a good game to watch with both teams scoring 39 points. Grey leads the Lions with 12, Bentley has 9 and Lucas 7. Rebounding edge by 2 to UTEP. Turnovers are even.
Only 4 fouls called on each team in the half and Mia Nickson has 2 of the PSU fouls.

The BLAME Game - Attacking the Departed
A Flurry of Finger Pointing by the Gov & Board draws a response from the Paterno Family.
This week the Governor of PA Tom Corbett reached a new low in a miserably underwhelming career by posthumously attacking Joe Paterno in a televised interview. In what appears to be a concerted and possibly choreographed assault the Board of Trustees of Penn State joined the chorus by releasing a statement confirming their unprincipled hasty decision to fire JoePa by telephone as they scrambled to cover their asses and the moon sized exposure of the ample posterior of the Governor. Govenor Corbett and his cronies over at The Second Mile who gave so generously to his campaign during the days his office was supposedly investigating sex abuse allegations made by a Second Mile child, desperately needed a highly visible scapegoat. None was more visible than the aging former boss of Jerry Sandusky so they decided to make this Second Mile Sandusky Scandal into the Paterno Penn State Scandal.
Today the Paterno family struck back to defend Joe against this posthumous assault placing the blame for the creation of this false Penn State Sex Crisis squarely on the shoulders of the Board of Trustees - the very group who's job it is to uphold the high standards and honor of Penn State University

The Lady Vols were 34 and 3 last year overall - 16 and 0 in the SEC - and made it to the elite eight
This year they are 20 and 8 and 11 and 4 looking at a 3 or 4 seed without winning the SEC Tournament and we are missing Kelly Cain and Angie Bjorklund while adding the point guard everyone said was the key and returning our 3 leading scorers with a healthy Vicki Baugh. Lauren Avant and Lyssi Brewer defected but they did not play much last year.
Nikki Caldwell at LSU already has them in a better position this season even after losing her point guard here at UT They went 19 and 13 and 8 and 8 in 2011 and failed to make the NCAA
Nikki has them at 20 and 8 and 10 and 5 with UGA coming to Baton Rouge
They are on a 6 game winning streak and tied for 3rd in the SEC and are seeded in the Bracketology in Nikki's first year. That's good coaching taking another coach's players and doing better even after losing a critical player.
This was a particularly good performance given the vast improvement in the overall strength of the SEC this year.
Just Curious - Why Doesn't BSD cover WCBB?
You have a Top 20 Women's team taking on tOSU for the league lead and yet there is no coverage here on this Penn State Sports site.
Over at Rocky Top Talk we have a game preliminary post, a long game thread, and a wrap up post for every Lady Vols Game - and we're in the South. I'm just a little surprised that a site in Pennsylvania wouldn't cover a Penn State team that's doing a great job representing the school.
If this is a sore subject or if I've overstepped my bounds by asking I will be happy to delete this but it seems to me some of you would enjoy covering the women in their quest to win the B1G and show up in the NCAA.
The game is currently on ESPN2 in HD and PSU is in the lead and playing well.
Now It Begins - 1st Assault on the Attorney General in the "PSU" Case
Lawyers for Tim Curley and Gary Schultz have filed motions for dismissal of charges and to compel the Attorney General to provide particulars in the Perjury and Failure to Report cases against their clients
This is something expected since the Perjury and Failure to Report charges were filed against Gary Schultz - Former Senior VP and this follows the same motions filed by Tim Curley the Athletic Director yesterday to dismiss the charges filed by Attorney General Linda Kelley. These charges seemed bogus and flimsy from the beginning. I speculated that the charges might not make it past the preliminary hearing but the judge was not interested in hearing about testimony concerning Dr Dranov and he was not going to toss the case out the door as should have been done.
Remember that Perjury charges in Pennsylvania require corroboration beyond any opposing versions of what might have been said between 3 people in a private meeting. Since only Curley, Schultz and Mike McQueary heard whatever was said in a "10 or 12 minute meeting" back in March of 2002 it is completely impossible to have corroboration if no notes, minutes, or recordings of that meeting exist.

Penn State Defended by the Media - How Can We Use It?
Just in case you've wondered where to go for positive media reports to share that were not articles written here on BSD there are a few that are quite good and useful for pointing out the truth. They just haven't gotten enough notice to counter the tsunami of negative press.
Three False Assertions by the Grand Jury turned the Press and Public against Joe Paterno and Penn State by Walter Uhler -This might be the best article yet written questioning the misleading work of the Attorney General Linda Kelly. It's not that there haven't been any articles or stories that were kinder to Penn State than the mass of stories in the National Media Frenzy sparked by the lies and distortions of the Attorney General. Video from Curley & Schultz Lawyers & mostly Odds a with few Ends
Take a few minutes and watch the lawyers for Curley and Schultz address the media on the Perjury charges brought by Attorney General Linda Kelly against the Athletic Director and the Sr. VP. These charges should never have been brought and the lawyers do a good job of explaining corroboration and the fact that Perjury cannot be successfully prosecuted when it is one person's word against another's word involving a conversation. Farrell is particularly good on "actions speak louder".

How Deep is The Rabbit Hole? - The Second Mile Down
This is a long complicated Fanpost I believe is my most important yet on the Second Mile Sandusky Scandal. I apologize but it will require some time and attention. I hope the conclusions and connections offer a clear conception of why this disaster was pushed on Penn State, and exactly who is culpable (outside of Jerry Sandusky) for the clearly unfair defamation of Penn State University and Joe Paterno. At the end you may have a new slant on the situation with some teeth that might have some traction outside of the Penn State community. It seems the world needs someone to blame - a villain to whom they can point or give the finger and rant and rage against. Maybe we can give them targets that are not Penn State or Paterno. I hope you find this compelling and useful, please bear with me - this is a Second Mile long - your Tennessee friend
DUELING CONSPIRACY THEORIES?
The media frenzy defaming PSU was created from misleading statements by Attorney General Linda Kelly and her Grand Jury Presentment leading to a common belief that Penn State through AD Tim Curley & Sr VP Gary Schultz as "Penn State" conspired to cover up an eyewitness account of sexual assault..People who tend to accept conspiracy theories have Linda Kelly's flawed theory. So. In order to satisfy conspiracy lovers I offer an alternative. First we must agree that a cover up is a conspiracy by definition an agreement by two or more persons to commit a wrongful act.
CONSPIRACY THEORY ONE --- The Penn State cover up conspiracy theory is written in the Victim 2 account in the Grand Jury Presentment and explicitly stated in Attorney General Linda Kelly's Press Release. This conspiracy theory gained maximum exposure and traction in the National Media Frenzy and is widely accepted in the court of public opinion. This video of Linda Kelley' press conference - particularly the statements of Kelly and PA State Police Commissioner Frank Noonan - and part two of that video support thier cover up conspiracy theory. Noonan goes out of his way to make Penn State's culture and climate a villiain in the investigation. Kelly equates Curley and Schultz with Sandusky in her remarks and their "complicity" makes this a conspiracy. Kelly dwells on the unidentified alleged victim 2 and speaks more about Curley and Schultz than she does about Sandusky. These statements by Kelley and Noonan are indefensible and with the Victim 2 section of the presentment were designed to bring down a firestorm of negative public opinion on the Penn State coach and administrators along with the entire Penn State community by association. This was no accident - It was a malicious act of defamation.
There are 8 brave young men who stepped up to lodge complaints against Jerry Sandusky but the Attorney General would have the country believe that Penn State's involvement is "EQUALLY SIGNIFICANT". Penn State is left with no choice but to defend itself and it's reputation against such malicious slander by the highest ranking law enforcement officer in the state and her mentor the Governor. But so far the Board of Trustees and the new President have not only failed to mount a defense, they have capitulated to the Attorney General's misleading claims. Penn State tried to be helpful to underprivileged kids by providing use of facilities to The Second Mile. Penn State raised millions to raise awareness about child abuse. Penn State has been made a villain by the Attorney General over the 2 sections of the Grand Jury Presentment with unidentified victims - victims 2 and 8 - who were allegedly abused on Penn State property.
Conspiracy Theory Two -- A cover up involving The Second Mile and it's board and executive director Jack Raykovitz who seem to have escaped notice or mention in anything issued by the Attorney General or her predecessor who is now Governor Tom Corbett. They are thus implicated in this conspiracy to make Penn State a defendant in the case against Jerry Sandusky in order to distract from shortcomings in the Attorney General's office investigation and the actions of The Second Mile where they got thousands of dollars for their campaigns.

Jack Raykovitz Did not inform Second Mile Board Members
This article gives several names of Second Mile Board Members who were not informed of Tim Curley's contact with Raykovitz about Jerry Sandusky. It seems Sandusky and Raykovitz were close friends. This is the guy who was protecting Sandusky while running the Second Mile charity where JS took his victims
Raykovitz and his wife received $233,000. in annual salaries from Second Mile for the years following the notification by Tim Curley that Sandusky would no longer be allowed to bring kids to use PSU facilities.
Second Mile contributed $25,000 to then Attorney General Tom Corbett's campaign for Governor and board members contributed thousands more.
Second Mile knew of the 1998 investigation and the Exec Director Raykovitz was informed of the 2002 decision by PSU administrators to ban Sandusky from bringing kids to workout at PSU, but it was not until the 2008 revelation by Sandusky himself that Second Mile acted to restrict his access to children using Second Mile

"First we had Paterno — after his failure to do enough to stop the grotesque abuse that is alleged to have occurred — leading a pep rally in his front yard because he and his sycophantic followers were still focused on things other than the children. Even the journalists without the guts to speak truth to JoePa power were smart enough to disappear quickly as could be.
Even cowards, when assessing things properly, can see the moral handwriting on the wall.

Atty Gen Linda Kelly Words and Motives - Where is Second Mile in This?
I find the Attorney Generals website featuring the Attorney General's Press Release on the Sandusky case is a study in misrepresentation of facts and truth.
We should blame this misrepresentation on an overzealous prosecutor in charge of the Grand Jury investigation for the language in the Grand Jury Presentment that was laughably wide of the mark in it's misleading description of the testimony of Mike McQueary. The Press Release by Attorney General Linda Harris leaves no doubt that the intentionally distorted Finding of Fact in the Presentment was a product of the woman in charge.
Now that we know about Second Mile's $25,000 donated to the campaign of now Gov. Corbett during the year he investigated Sandusky following the complaint of Victim 1 we have more reason to question the motives of the Attorney General. We also know that board members of Second Mile donated thousands more to Corbett.
Why have we not heard any testimony from the Executive Director of Second Mile?
He was informed of the 1998 investigation and was contacted by Tim Curley in Mar of 2002. We know Sandusky's victims were Second Mile kids and we can assume that the alleged "victim" 2 was also a Second Mile kid. Did they not keep tabs on what Sandusky or other adults were doing with those children? Did they not investigate people who might take those kids out for outings and events? How did Second Mile operate and why are they not a focal point of this investigation?
Did the money to Corbett buy their immunity?

Anatomy of a Media Frenzy
The sheer number of 'news and sports' stories that flooded the airwaves, internet, and news stands was epic. And the vast majority used the Grand Jury Presentment - a summary of allegations designed to justify an indictment - as if it were the unassailable truth. Few if any chose to point out this document contained no quotes, Q&A, exculpatory evidence, or cross examination and was strictly the prosecutions carefully crafted theory of the case.
The Presentment buried a victim 2 section with no identifiable victim in a raft of testimony by six brave young men who had come forward to launch the investigation of Jerry Sandusky. There was little to indicate that victim 2 of the Mar 1, 2002 incident that claimed a graduate assistant coach later identified as Mike McQueary "SAW a young boy BEING SUBJECTED TO ANAL INTERCOURSE", was not among those who were known to prosecutors.
It was thus the Penn State Scandal was born instead of the Sandusky Scandal or the Second Mile Scandal and Head Coach Joe Paterno, AD Tim Curley, Senior VP Gary Schultz, and PSU President Graham Spanier became the villains raked over the coals by frothing talking heads and writers attempting to out holy each other on national TV or fill the internet and printed media with ever bolder muck-raking.
If you care or dare - below the jump is a sample of the hysterical preaching that has attempted to rob Penn State students and alumni of their justified pride in their university and it's honorable football program run by a good and decent man who spent 61 years building a fine reputation only to see it in ruins as the result of that bold lie in the presentment.
As much as we might wish this over and done with, this harm done to Penn State and the public perception by our National Media and it's thirst for victims should not be forgotten or forgiven. As an outsider I am repelled by this mass of misinformation and it pains me to know there were far too few outside of Penn State people who even attempt to see past this flood of crap.

The Rhythm of Reasonable Doubt ?
How about an over the top take on the rhythm of the Grand Jury Presentment while we celebrate the new year? Because It seems so strange that Joe Paterno would be in this current predicament because of a couple of 2 second glances and the "Rhythmic Slapping Sounds that led Mike McQueary to suspect sexual activity"? I am not trying to make light of the clever, evil, and devious Sandusky and the horror of his sick actions.
I believe the Attorney General and the Governor have a lot of explaining to do as it turns out. Joe and the good people of Penn State have paid the price for the misleading false statements in the Grand Jury presentment authored by the Attorney General's office. Her press release was another study in totally misleading overstatement and we haven't even gotten to that absurdity but we will. But this week I've Got RHYTHM to discuss.

The Grand Jury Presentment made many believe that Mike Mcqueary was EAR witness to a sex act. Mike only observed Sandusky and the boy for 1 or 2 seconds in direct view of Sandusky's backside that blocked any view of genitals or hands. So it had to be this "rhythmic slapping" sexual sound that made him so certain of an "extremely sexual" situation did it not?
Just how does one infer sex or rhythm from 3 claps or slaps?
The Grand Jury Presentment read:
"He then heard rhythmic slapping sounds. He believed the sounds to be those of sexual activity"
This was a key part of a 45 second locker room visit where the Grand Jury that voted for the Attorney General's presentment claiming that Mike "saw" a boy being subjected to "anal intercourse". We have learned that is untrue. But those Rhythmic Slapping Sounds surely they were the origin of Mike's certainty. A rhythm of slapping that could only come from sexual activity makes sense. That rhythm coupled with the glances might add up to something --- but

In 2010, then-Attorney General Tom Corbett accepted a $25,000 political contribution from The Second Mile. Now Gov. Corbett is saying that he didn't return the money because it would've tipped off The Second Mile that its founder was being investigated for alleged child sex abuse.

Final Take - Grand Jury & Media Manufactured "PSU Sex Scandal"
A more concise overview based on all available evidence after the Perjury Hearing on Friday Dec 16th - an attempt to boil down my obese verbiage into it's basic essence. Toss out everything else I've written - this is the whole story in as small a nutshell as I can make it - from the outsider in Tennessee. There is NO PSU Sex Scandal.
If the Grand Jury Presentment had simply accurately described Mike McQueary's testimony as "strong suspicion of sexual activity based on a brief glance in the shower and some slapping sounds" do you think Joe and PSU would have suffered this vilification? That is the first question you need to answer.
Based on a misleading Grand Jury Presentment and Perjury Hearing Testimony under oath by Mike McQueary; we can derive the simplest explanation for what transpired in Mike's meetings with Joe and then with Tim and Gary.
How accurate, graphic, and believable was McQueary when speaking to Joe Paterno? What did he and Joe say to Tim Curley and Gary Schultz? If MIke handled his talks with them like the light cross-examination at the Perjury Hearing I believe their reaction would have been: No reason to call police when the only suspicion is based on a 3 second glance of Jerry's back and 3 slapping sounds that did not confirm any criminal act. Reporting suspicion is not required or even advisable. This will be a leap for some of you but a long review of the tweets make this conclusion compelling.

Paterno legacy likely trails coaching icons
This is the worst kind of ESPN crap. One writer admits that they have tarnished Joe Paterno's legacy almost certainly a permanent thing. Yet lays no blame on ESPN as one of the chief participants in this travesty of justice.
I know - why should I expect anything different? But it still pisses me off more that just shutting up about it would. Now they try to offer a fair opinion? What a crew of jerks.
"I Know What Should Have Been Done and What I Would Have Done"
It is interesting to see the people who have such superior moral character when compared to Joe Paterno, Tim Curley and Gary Schultz. Those mostly anonymous comment givers, media members, and letter writers who seem so certain of their ability to have made a difference in the days following March 1, 2002. How did 3 men of such weak character rise to such positions of responsibility at Penn State? I am struck by what I see as a common thread in the comments of those who write to scold or condemn Joe Paterno, or Curley or Schultz or all three. They seem to have an unshakable moral compass that tells them what they would have done that these three men failed to do some 9 years ago.
Most of these online judges and muckrakers and the rest of us don't know Jerry Sandusky like Joe, Tim and Gary did. And we don't know Mike McQueary like Joe did. But some of us are certain that we know what Joe or Tim or Gary did is wrong. How is that I wonder?
How do any of us know what we would have done or what they should have done without understanding what crossed their minds in two 10 minute meetings based on a report of a 45 second locker room visit that included under 10 seconds of observations over 9 years ago prior to the publication of the summary of allegations designed to justify indictment of Jerry Sandusky? Maybe we should consider what we know about that time in order to understand.

Dr. Jonathan Dranov puts final nail in media coffin regarding Joe Paterno.
The out of control, dishonest media frenzy involving Joe Paterno was as much an abuse of the first amendment as Sandusky's alleged abuse of children. And just as vile. And unfortunately for the country a lot more frequent. But maybe this time, if enough people get angry, it will be time for some real accountablity for the news media and there will be demands that wrongs and injustices be made right.
